LUNA AI — END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“EULA” or “Agreement”) is a legal agreement between you (“you” or “End User”) and Smart Media Internet Marketing Ltd., with offices at Sderot Hayahsut 11, Beer Sheva, Israel (“Smart Media,” “Luna,” “Luna AI,” “Company,” “we,” “us,” or “our”).

This EULA governs your download, installation, access to, and use of the Luna AI mobile application and any related software, updates, content, tools, features, and functionality provided through the app (collectively, the “App”).

IMPORTANT: By downloading, installing, accessing, or using the App, you confirm that:

(a) you have read and understood this EULA; and

(b) you agree to be legally bound by it.

If you do not agree, do not use the App and uninstall it.

This EULA may reference our Privacy Policy and other policies (collectively, “Policies”). If there is a conflict between this EULA and a Policy on a specific topic, the policy governing that topic will control for that topic.

1. THE APP

1.1 Description. Luna AI is a software application designed to provide an AI companion experience, which may include (depending on features available in your version/region) text-based conversations, voice interactions, role-play scenarios, and other interactive experiences.

1.2 No regulated use. The App is not designed for, and is not intended to comply with, industry-specific regulations (including, for example, HIPAA, GLBA, FISMA, or similar). Do not use the App in connection with regulated data or in any manner that would violate applicable laws.

2. SCOPE OF LICENSE

2.1 License grant. Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control solely for your personal, non-commercial use, as permitted by applicable app store usage rules (“Usage Rules”).

2.2 Updates. This license also governs any updates or upgrades to the App we provide, unless an update is accompanied by a separate license, in which case that separate license governs.

2.3 Restrictions. Except as expressly permitted by law, you may not:

(a) copy, modify, translate, adapt, or create derivative works of the App;

(b) reverse engineer, decompile, disassemble, or attempt to derive source code or underlying ideas/algorithms of the App;

(c) rent, lease, lend, sell, redistribute, or otherwise make the App available to any third party (except as allowed by Usage Rules);

(d) bypass, disable, or interfere with security-related features or access controls; or

(e) remove or alter any proprietary notices.

2.4 Ownership. The App is licensed, not sold. We reserve all rights not expressly granted to you.

3. ELIGIBILITY & AGE

3.1 Age. You may only use the App if you meet the minimum age required to download/use the App in your jurisdiction and under the relevant app store rating/requirements. If you are under the age of majority where you live, your parent/legal guardian must review and agree to this EULA on your behalf, and you may only use the App under their supervision.

3.2 No use by children where prohibited. The App is not directed to children and may not be used by individuals who are below the applicable minimum age.

4. YOUR ACCOUNT & SECURITY

4.1 Account. Certain features may require an account. You agree to provide accurate, current, and complete information and keep it updated.

4.2 Security. You are responsible for safeguarding your account credentials and all activity under your account. Notify us promptly of any suspected unauthorized access.

5. TECHNICAL REQUIREMENTS; UPDATES

5.1 Compatibility. You are responsible for ensuring your device meets the App’s requirements (including OS version, storage, and connectivity).

5.2 Updates and changes. We may modify the App, including features and technical specifications, at any time. We do not guarantee that we will maintain any particular feature, interface, or compatibility.

5.3 Availability. The App may be unavailable from time to time due to maintenance, outages, or other reasons.

6. NO MAINTENANCE OR SUPPORT

6.1 No obligation. We are not obligated to provide maintenance, technical support, or updates, except as required by applicable law.

6.2 App store providers. Apple, Google, and other distribution platforms are not responsible for maintenance or support.

7. USE OF DATA; PRIVACY

7.1 Privacy Policy. Your use of the App is subject to our Privacy Policy, which describes how we collect, use, disclose, and safeguard information.

7.2 Technical and usage data. We may collect and use technical data and related information about your device and use of the App to operate, maintain, improve, and support the App, including troubleshooting and product analytics.

7.3 Interaction and training data. To improve the App and its underlying models, we may process interaction data (including chat and usage patterns) as described in our Privacy Policy. Where applicable, we may de-identify/anonymize or aggregate data before using it for improvement and training purposes.

7.4 Consent-based analytics/session recording (if enabled). If we offer optional analytics/session recording features, they will only be enabled as described in the applicable in-app setting/consent flow, and you may be able to opt out through the App settings where available.

8. AI FEATURES; USER SAFETY; NO PROFESSIONAL ADVICE

8.1 AI output. The App may generate outputs automatically (including messages, suggestions, or other content) (“AI Output”). AI Output may be inaccurate, incomplete, or inappropriate and should not be relied upon as factual or definitive.

8.2 No professional advice. The App does not provide medical, mental health, legal, financial, or other professional advice. If you need professional help, consult a qualified professional.

8.3 Not for emergencies. Do not use the App for emergency situations or to contact emergency services.

8.4 Your responsibility. You are responsible for how you use the App and any decisions you make based on AI Output.

9. USER CONTENT & USER-GENERATED CONTRIBUTIONS

9.1 User Content. “User Content” means any content you submit, upload, transmit, generate, or otherwise make available through the App (including text, images, audio, prompts, and other materials).

9.2 Visibility. Some User Content may be visible to you, and depending on features, may be shared with others or used to provide the App’s functionality.

9.3 Your representations. You represent and warrant that:

(a) you own or have the necessary rights/permissions to provide the User Content;

(b) your User Content does not infringe any third party rights (including IP, privacy, or publicity rights);

(c) your User Content complies with this EULA and applicable laws; and

(d) you have obtained any required consents from individuals depicted or referenced in your User Content.

10. USER CONTENT LICENSE; FEEDBACK

10.1 License to us. By providing User Content, you grant us a worldwide, non-exclusive, royalty-free, fully-paid, transferable, sublicensable, perpetual, irrevocable license to host, store, reproduce, modify, adapt, translate, display, perform, distribute, and otherwise use your User Content:

(a) to operate, provide, and improve the App;

(b) to develop, train, evaluate, and improve our models and services (consistent with our Privacy Policy and applicable law); and

(c) for compliance, safety, trust, security, and legal obligations.

10.2 Moral rights. To the extent permitted by law, you waive and agree not to assert moral rights in your User Content against us or our licensees.

10.3 Feedback. If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation.

11. PROHIBITED CONDUCT; COMMUNITY STANDARDS

11.1 Prohibited conduct. You agree not to:

(a) use the App for unlawful purposes or in violation of any law;

(b) harass, threaten, abuse, defame, or harm others;

(c) create, share, or request content that exploits or sexualizes minors, facilitates trafficking, or otherwise endangers children;

(d) impersonate any person or entity or misrepresent affiliation;

(e) attempt to gain unauthorized access to systems, accounts, or networks;

(f) interfere with the App’s operation or security;

(g) upload malware or harmful code;

(h) scrape, data mine, or systematically extract data from the App except as permitted by law;

(i) use the App to generate or disseminate content that is hateful, violently extremist, or that incites violence; or

(j) use the App in a manner that could harm our users, our services, or our reputation.

11.2 Enforcement. We may (but are not required to) monitor, review, remove, restrict, or disable access to User Content or accounts at any time, including for suspected violations, safety concerns, or legal compliance, without prior notice.

11.3 No tolerance for objectionable content/abuse. We have no tolerance for objectionable content or abusive users. Users may be suspended or banned at our sole discretion.

12. SUBSCRIPTIONS, IN-APP PURCHASES, AND PAYMENTS

12.1 Purchases. The App may offer subscriptions or one-time purchases. Prices and terms are shown at point of purchase.

12.2 Billing by platform. If purchased through Apple App Store or Google Play, billing, renewals, cancellations, and refunds are handled by the platform and subject to its terms. We do not control platform refund decisions.

12.3 Auto-renewal. Subscriptions may automatically renew unless canceled through your platform account settings before the renewal date.

12.4 No refunds except as required. Except where required by applicable law or platform policy, payments are non-refundable.

12.5 Changes. We may change pricing or subscription offerings with notice where required.

13. INTELLECTUAL PROPERTY RIGHTS

13.1 Our IP. The App, including its software, design, user interface, content (excluding User Content), trademarks, and all related IP rights, are owned by us or our licensors and are protected by applicable laws.

13.2 Reservation. All rights not expressly granted to you are reserved by us.

14. THIRD-PARTY SERVICES, LINKS, AND TERMS

14.1 Third-party services. The App may integrate with or link to third-party services or content. We do not control third-party services and are not responsible for their content, policies, or practices.

14.2 Third-party terms. Your use of third-party services is subject to their terms, and you are responsible for complying with them.

15. WARRANTY DISCLAIMER

15.1 As-is. To the maximum extent permitted by applicable law, the App is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

15.2 No guarantees. We do not warrant that the App will be uninterrupted, secure, error-free, or that defects will be corrected, or that AI Output will be accurate or reliable.

16. LIMITATION OF LIABILITY

16.1 Limitation. To the fullest extent permitted by law, in no event will we (or our affiliates, directors, officers, employees, contractors, licensors, or service providers) be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your use of (or inability to use) the App.

16.2 Cap. To the fullest extent permitted by law, our total liability for all claims relating to the App will not exceed the amount you paid to us (if any) for access to the App in the twelve (12) months preceding the event giving rise to the claim.

17. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless us and our affiliates and personnel from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:

(a) your use of the App;

(b) your User Content;

(c) your violation of this EULA or applicable law; or

(d) your infringement of any third party rights.

18. TERMINATION

18.1 Term. This EULA is effective until terminated.

18.2 Termination by you. You may terminate by uninstalling the App and ceasing all use.

18.3 Termination by us. We may suspend or terminate your access to the App at any time if we reasonably believe you violated this EULA or for safety, security, or legal reasons.

18.4 Effect. Upon termination, the license granted to you ends and you must stop using the App and delete all copies. Sections that by their nature should survive will survive (including IP, disclaimers, limitations, indemnity, and dispute provisions).

19. PRODUCT CLAIMS

19.1 Responsibility. We, not Apple/Google or any app store provider, are responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal requirements, and claims under consumer protection or privacy laws.

20. LEGAL COMPLIANCE (EXPORT/SANCTIONS)

You represent and warrant that:

(a) you are not located in a country subject to embargo or sanctions that would prohibit use of the App; and

(b) you are not listed on any restricted party list.

You agree to comply with all applicable export control and sanctions laws.

21. GOVERNING LAW; DISPUTE RESOLUTION; CLASS-ACTION WAIVER

21.1 Governing law. This EULA (and any dispute or claim arising out of or related to it) is governed by the laws of Israel, without regard to conflict-of-law rules.

21.2 Venue. Any legal suit, action, or proceeding arising out of or related to this EULA or the App shall be instituted exclusively in the competent courts located in Israel, unless applicable law requires otherwise.

21.3 Informal resolution. Before filing a claim, you agree to attempt to resolve the dispute informally by contacting us and providing a description of your issue and the relief sought. If not resolved within 30 days, either party may pursue formal proceedings.

21.4 Class-action waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action, to the maximum extent permitted by law.

22. MISCELLANEOUS

22.1 Severability. If any provision of this EULA is held invalid or unenforceable, the remaining provisions remain in full force and effect.

22.2 No waiver. Our failure to enforce any provision is not a waiver.

22.3 Assignment. You may not assign this EULA without our prior written consent. We may assign this EULA in connection with a merger, acquisition, or sale of assets.

22.4 Changes. We may update this EULA from time to time. If changes are material, we may provide notice via the App or otherwise. Continued use after the effective date of the updated EULA constitutes acceptance.

22.5 Entire agreement. This EULA and the Policies constitute the entire agreement between you and us regarding the App.

APP STORE / PLAY STORE ACKNOWLEDGEMENTS (THIRD-PARTY BENEFICIARY)

Apple and Google (and their subsidiaries) are third-party beneficiaries of this EULA, and upon your acceptance, they have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary. Apple/Google are not parties to this EULA and have no obligations to provide maintenance or support for the App.

This EULA is intended to be consistent with applicable Usage Rules and platform terms. If there is a conflict with mandatory platform terms, those mandatory terms control.

    Welcome to ViewCaller! We offer a variety of additional features in exchange for a one-time or recurring fee, applicable to the specific features you choose (each a “Paid Service” and collectively the “Paid Services”).

    By subscribing to or using any Paid Service, you agree to these Specific Terms for Paid Services (“Additional Terms”) in addition to the ViewCaller Terms of Service and the ViewCaller Privacy Policy (collectively, the “Terms”). “ViewCaller” refers to the entity providing the Paid Services to you under these Terms.

    Please read these Additional Terms carefully. They outline our commitments to you and your responsibilities when using the Paid Services. We may update these terms periodically, especially when introducing new features. It is your responsibility to review them regularly and before using new features. If you do not understand or agree with any part of these Additional Terms, you may not use the Paid Services.


    Paid Services

    We provide a broad range of services available at ViewCaller Premium. The features accessible to you may vary depending on your geographical location and subscription plan. Some features may also be subject to limitations imposed by your network carrier. Below are details about certain Paid Services with specific requirements or additional resources:

    Assistant

    • Functionality: The Assistant allows you to forward declined or missed calls before you pick them up and receive detailed information about these calls.
    • Interactive Responses: After answering a call, the Assistant plays a pre-recorded interactive message to the caller.
    • Customization: You can choose how and when the Assistant responds by selecting scripts and reviewing conversations between the Assistant and the caller.
    • Spam Detection: The Assistant uses automated methods to detect robocalls and top spammers from numbers in ViewCaller’s spam database.
    • Setup: We’ll guide you through configuring your phone’s conditional call forwarding so that declined and missed calls are forwarded to the Assistant.

    Synthetic Voice Feature

    • Personalization: Customize the Assistant to sound like you by creating a synthetic voice model using your own voice recordings.
    • Usage: Your voice recordings are used solely to create and use the synthetic voice model within the Assistant.
    • Privacy: We will not use your voice recordings or synthetic voice model for any other purpose without your explicit consent.
    • Control: You can delete your voice recordings and the synthetic voice model at any time through the ViewCaller app settings.

    Call Recording

    • Functionality: Record individual phone conversations and save the recordings to your device.
    • Transcription: Optionally create transcriptions of recordings and search within them.
    • Storage: Recordings and transcripts are stored only on your device; ViewCaller does not have access to them.
    • Usage Responsibility: You are responsible for using the recordings lawfully (see “Your Responsibilities” section).
    • Limitations: The maximum recording time is limited to 24 hours per month to prevent misuse.

    AI Call Scanner

    • Purpose: Detect AI-synthesized voices to protect yourself against potential scams and fraudulent activities.
    • Operation: Captures and analyzes parts of the call using automated methods to determine whether the caller is human or AI.
    • Privacy: Recordings are encrypted and used only for analysis, then deleted immediately afterward.

    User Verification

    • Verification Badge: Allows premium subscribers (individuals only) in certain regions to verify their profiles and obtain a verified badge.
    • Duration: Verification remains active during your premium subscription unless canceled by ViewCaller.
    • Voluntary: User verification is entirely voluntary and may change over time.
    • Process: Currently involves fetching the name registered with your UPI-enabled bank account linked to your registered mobile number.
    • Consent: You must consent to use this name as your profile name on the ViewCaller app.
    • Changes: If you change your profile name, you will lose the verified badge and need to re-verify.
    • Privacy: No other bank account information is obtained during verification.

    Communication Charges

    • Carrier Fees: Unless explicitly stated, Paid Services (including Assistant and Call Recording) do not use Wi-Fi or mobile data and will incur carrier call minutes and applicable fees according to your mobile service plan.
    • Inclusions: This includes calls answered by the Assistant and recorded conversations.
    • Exclusions: These Terms do not apply to carrier-provided features and services like SMS or MMS.
    • Responsibility: You are responsible for any fees or surcharges imposed by your carrier or mobile service provider.

    Your Responsibilities

    • Legal Compliance: Laws regarding recording and transcribing conversations vary. Before using Call Recording, familiarize yourself with local laws to determine if you need the other party’s permission.
    • Consent: You are responsible for obtaining prior consent from other parties if required.
    • Content Sharing: Comply with local laws when sharing content generated through the Paid Services.
    • Settings: We offer controls to help you set preferences based on your country. Where feasible, we provide customizable call recording settings, including beep tones or notifications to indicate recording.

    Acceptable Use

    We aim to provide a safe and enjoyable experience. You agree to use the Paid Services only for lawful, personal purposes.

    Prohibited Actions:

    • Sharing content that may breach third-party copyrights.
    • Transmitting unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or objectionable material.
    • Encouraging conduct that constitutes a criminal offense or violates any laws.
    • Impersonating another person or misrepresenting yourself or the source of any call.
    • Distributing others’ personal and confidential information without permission.
    • Abusing or misusing the Paid Services.
    • Modifying, adapting, translating, or reverse-engineering any part of the Paid Services.
    • Removing any copyright, trademark, or proprietary rights notices.
    • Using Call Recording without determining its legality.

    Consequences:

    Violations may result in review and action, including limiting or terminating your access to Paid Services. Illegal activities may lead to being banned from the ViewCaller app and/or reported to authorities.

    Privacy

    We process personal data to provide the Paid Services. The types of data depend on how you use the services and which features you utilize.

    Data We Collect:

    • Subscription Information: Order ID, invoice ID, products purchased, payment status, and order status. Family member phone numbers for certain plans.
    • Carrier Information: Phone number and carrier details to ensure compatibility.
    • Call Data: Information about calls, including recordings and transcripts. May include data about non-users.
    • Contacts: Access to your phonebook contacts if you choose to set different forwarding rules.
    • Device and Log Data: App installation status, call durations, call statuses.
    • Training Data: With explicit consent, selected audio segments may be used to train our AI technology (data will be anonymized).

    Privacy Policy:

    Any personal information provided to ViewCaller is used and protected according to the ViewCaller Privacy Policy. This section describes features specific to Assistant and Call Recording and should be read in conjunction with our Privacy Policy.

    Limitations of Service

    While we strive for accuracy, we cannot guarantee that the Paid Services will always provide accurate results or operate without errors. Factors like speech recognition variables may affect performance.

    Limited Warranties

    Subject to mandatory law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to accuracy, uninterrupted service, or error-free operation. If you experience issues, please contact [email protected], and we’ll make reasonable efforts to fix them.

    Limitation of Liability

    We are not liable for any direct, indirect, incidental, or consequential damages arising from:

    • Mistakes, omissions, interruptions, delays, defects, or errors in providing the Paid Services.
    • Errors in blocking, transmitting, receiving, originating, terminating, or delivering calls.
    • Inaccuracies in information provided by the Paid Services.
    • Your use of, inability to access, or difficulty accessing Paid Services through certain numbers.

    User Responsibility:

    Ensure you have all required system elements that are compatible, properly configured, and fully functional. You must comply with all applicable laws when using the Paid Services.

    Maximum Liability:

    Unless required by mandatory law, our aggregate liability will not exceed the fees you have paid for the Paid Services.

    Service Interruptions

    Paid Services may be temporarily suspended without notice for reasons such as security, system failures, maintenance, or other circumstances. No refunds will be provided for these temporary suspensions.

    Changes to Paid Services

    We may modify or discontinue Paid Services at our discretion. ViewCaller is not liable for any modification, suspension, or discontinuance of the services. Refer to the ViewCaller Terms of Service for information on canceling subscriptions or seeking refunds.

    • Storage: Transcripts and recordings are stored only on your device; ViewCaller has no access to them.
    • Limitations: The maximum time for Call Recording is limited to 24 hours per month to prevent abusive usage.
    • Responsibility: You are responsible for using the recording lawfully and complying with local laws, including obtaining prior consent from other parties if necessary.

    2.4 AI Call Scanner

    • Purpose: Detect AI-synthesized voices to safeguard against potential scams and fraudulent activities.
    • Operation: Captures and analyzes parts of the call using automated means to determine if the caller is human or AI.

    2.5 Fraud Insurance

    • Coverage: Provides insurance against digital communication frauds perpetrated on your ViewCaller registered number.
    • Eligibility: Available only to yearly premium subscribers (AI Assistant plan and above) in specific regions, such as India.
    • Cost: Enjoy insurance benefits at no additional charge during your active yearly premium subscription.
    • Provider: Insurance is provided by a third-party insurer under the “Cyber Sachet Insurance” plan. ViewCaller acts solely as the master policyholder and is not the insurance provider.
    • Terms: Insurance coverage is subject to the terms, conditions, and limitations of the insurance plan offered by the insurer.
    • Enrollment: You must actively enroll for Fraud Insurance via the ViewCaller app and agree to share your registered number with the insurer.
    • Claims: You are solely responsible for filing claims with the insurer and submitting relevant documents. ViewCaller does not handle claims processing and is not responsible for claim outcomes.

    2.6 User Verification

    • Verification Badge: Allows premium subscribers (individuals, not businesses) in specific regions to verify themselves on the ViewCaller app and obtain a verified badge on their profile.
    • Duration: Verification status remains active during your premium subscription unless canceled by ViewCaller at its discretion.
    • Voluntary: User verification is entirely voluntary, and methods may change over time as determined by ViewCaller.
    • Current Process: Currently carried out in association with a third-party service provider. Verification involves fetching the name registered with the UPI-enabled bank account linked to your registered mobile number.
    • Requirements: You must have an active UPI-enabled bank account linked with your registered mobile number and consent to use the name registered with such bank account as your profile name on the ViewCaller app.
    • Changes: If you change your profile name, you will lose the verified badge and will need to re-verify.
    • Privacy: No other information related to your bank account is obtained by ViewCaller or its Verification Partner during the verification process.

    3. Communication Charges

    • Carrier Fees: Unless explicitly stated, Paid Services (including the Assistant and Call Recording) do not use Wi-Fi or mobile data and will incur carrier call minutes and applicable fees according to your mobile service plan.
    • Includes: This includes calls answered by the Assistant and recorded conversations.
    • Exclusions: These Terms do not apply to features and services provided by your carrier (such as carrier calling and messaging through SMS or MMS).
    • Responsibility: You are solely responsible for any fees or surcharges imposed by your carrier or mobile service provider, in accordance with your agreement with them.

    4. Your Responsibilities

    • Legal Compliance: Laws regarding notification requirements for recording and transcribing conversations vary across jurisdictions. Before using Call Recording, familiarize yourself with local laws to determine if you need the other party’s permission.
    • Consent: As the user, you are responsible for complying with local laws when using Call Recording, including obtaining prior consent from other parties where necessary.
    • Content Sharing: You are also responsible for complying with local laws when sharing content generated through the Paid Services with third parties.
    • Settings: We provide various controls to help you set your preferences based on your country of residency. Where allowed and technically feasible, we offer customizable call recording settings to help you comply with local laws. These settings include options such as a beep tone or other notifications to indicate that the call is being recorded. You can also choose to activate or deactivate transcriptions.

    5. Acceptable Use Policy

    We aim to provide a safe and enjoyable experience for our users. You agree to use the Paid Services only for personal, lawful purposes.

    You agree not to:

    • Share photo or message content that may breach third-party copyrights.
    • Use the Paid Services to transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racially, ethnically, or otherwise objectionable material.
    • Encourage conduct that would constitute a criminal offense, give rise to civil liability, or violate any applicable laws.
    • Impersonate another person or misrepresent yourself or the source of any phone call.
    • Distribute others’ personal and confidential information, such as credit card numbers, confidential national ID numbers, or account passwords, without permission.
    • Abuse or misuse the Paid Services.
    • Modify, adapt, translate, or reverse-engineer any portion of the Paid Services.
    • Remove any copyright, trademark, or other proprietary rights notices contained in or on the Paid Services.
    • Use Call Recording unless you have determined that your use is legal.

    Consequences of Violations:

    When we identify a potential violation, we may review and take action, including limiting or terminating your access to the relevant Paid Service(s). Illegal activities may result in you being banned from the ViewCaller application and/or being reported to authorities.

    6. Privacy

    We process personal data to provide our services. The data types we process depend on how you use the Paid Services and which features you utilize.

    We collect and process:

    • Subscription Information: Details about your subscription status, such as order ID, invoice ID, purchased products, payment status, and order status. For certain family subscription plans, we collect family member phone numbers.
    • Carrier Information: Your phone number and carrier details to ensure compatibility with the Paid Services.
    • Call Data: Information about calls handled by our services, including call duration, call status, recordings, and transcripts. This may include information about non-users, such as phone numbers and names.
    • Contacts: If you wish to establish different forwarding rules for calls from your contacts, you can provide access to your phonebook contacts. We only store phone numbers, not names, photos, or email addresses. You can revoke this permission at any time.
    • Device and Log Data: Information about app installation status, call durations, call statuses, and other usage data.
    • Training Data: With your explicit consent, we may select segments of audio and associated transcriptions to train our AI technology. We will anonymize such data before processing.

    Any personal information provided to ViewCaller will be used and protected in accordance with our Privacy Policy. This clause describes features specific to the Assistant and Call Recording and should be read in conjunction with our Privacy Policy.

    7. Limitations of Service

    While we strive to provide accurate, current, and rich data, we cannot guarantee the accuracy of the results the Paid Services provide. Due to variables in speech recognition, the Assistant and AI Call Scanner may not fully understand what a caller says or detect all spam calls and robocalls.

    8. Limited Warranties

    Due to the limitations described, and subject to mandatory law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to warranties of accuracy, uninterrupted service, or error-free operation. If you experience issues with the Paid Services, please contact [email protected], and we will make reasonable efforts to address the issue.

    9. Limitation of Liability

    We are not liable for damages of any type, whether direct, indirect, incidental, or consequential, arising out of or related to the use of the Paid Services. This includes but is not limited to damages arising from mistakes, omissions, interruptions, delays, defects, or errors in providing the Paid Services.

    This applies to errors in blocking, transmitting, receiving, originating, terminating, and/or delivering telephone calls and to any inaccuracies in information provided using the Paid Services.

    We are not liable for damages arising out of or related to your use of, inability to access, or difficulty in accessing Paid Services through toll or local access numbers. It is your responsibility to ensure you have all required system elements, that they are compatible, properly configured, and fully functional. You must comply with all laws applicable to your use of the Paid Services before registering or using them. We disclaim all liability for any failure on your part to comply with these requirements.

    Unless required by mandatory law, under no circumstances will our aggregate liability exceed the fees you have paid for the Paid Services.

    10. Service Interruptions

    Paid Services may be suspended temporarily, without notice, for security reasons, system failures, maintenance and repair, or other circumstances. To the fullest extent permitted by applicable law, you will not be entitled to any refund for these temporary suspensions.

    11. Changes to Services

    As we continually evolve our Paid Services, we may stop providing them permanently or temporarily at our discretion. ViewCaller will not be liable to you or any third party for any modification, suspension, or discontinuance of the Paid Services. The applicable Terms specify how you can cancel a subscription or seek a refund.


    By using ViewCaller, you acknowledge that you have read, understood, and agree to these Terms of Service.
