Smart Media Internet Marketing Ltd. (“Tap Mobile,” “we,” “us,” or “our”) provides a portfolio of mobile applications, websites, APIs and related services (collectively, the “Service”). By accessing or using the Service, you (“you” or “your”) agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Service.
1. Acceptance of Terms
1.1. These Terms constitute a binding agreement between you and Tap Mobile.
1.2. If you are under the age of majority in your jurisdiction, you must have a parent or guardian agree on your behalf.
2. Changes to Terms
2.1. We may modify these Terms at any time by posting a revised version with a new “Last Updated” date.
2.2. Continued use of the Service after changes are posted constitutes your acceptance.
3. Privacy Policy
3.1. Use of the Service is also governed by our Privacy Policy, available at https://tap.pm/privacy-policy-v5/.
4. Eligibility
4.1. You must be at least 13 years old to use the Service.
4.2. We reserve the right to suspend or terminate accounts that violate this provision.
5. Account Registration
5.1. Certain features require you to create an account. You agree to provide accurate, current and complete information.
5.2. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
6. Subscription Plans & Payments
6.1. We offer free and paid subscription plans. Fees, payment methods and billing cycles are set forth on our pricing page.
6.2. Paid subscriptions auto‑renew unless canceled before the end of the current term. You may cancel via account settings; no partial‐period refunds.
6.3. You are responsible for all applicable taxes. Unauthorized chargebacks may result in suspension of your access.
7. License & Ownership
7.1. Tap Mobile grants you a limited, non‑exclusive, non‑transferable, revocable license to use the Service on your compatible device.
7.2. All rights not expressly granted to you are reserved by Tap Mobile and its licensors.
8. User Content
8.1. You retain all ownership rights in content you submit. By submitting User Content, you grant Tap Mobile a worldwide, royalty‑free license to use, reproduce, distribute, display and modify it for purposes of operating and promoting the Service.
8.2. You represent and warrant that you have all rights necessary to submit your User Content and that it does not violate any law or third‑party right.
9. Prohibited Conduct
You agree not to:

Violate any applicable law, regulation or third‑party right.

Harass, threaten or harm others.

Reverse‑engineer, decompile or tamper with the Service.

Scrape, data‑mine or harvest data without authorization.

Interfere with our networks, servers or other users’ enjoyment of the Service.
10. Third‑Party Services
10.1. The Service may integrate or link to third‑party platforms, SDKs and payment processors. We are not responsible for their terms, privacy practices or availability.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON‑INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAP MOBILE’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO TAP MOBILE IN THE PRIOR TWELVE MONTHS. IN NO EVENT SHALL TAP MOBILE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES.
13. Indemnification
You agree to defend, indemnify and hold harmless Tap Mobile and its officers, directors, employees and agents from any claims, liabilities, damages or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your use of the Service.
14. Governing Law & Jurisdiction
These Terms and any dispute arising out of them are governed by the laws of Israel. You agree that any legal action will be brought exclusively in the courts of Israel after good‑faith efforts to resolve informally via [email protected].
15. Severability & Waiver
If any provision is held invalid, the remainder shall remain in full force. No failure or delay by Tap Mobile in enforcing any right under these Terms constitutes a waiver.
16. Entire Agreement
These Terms, together with any documents they expressly incorporate, constitute the entire agreement between you and Tap Mobile regarding the Service.
